General terms and conditions in the automobile industry

For many years, the General Terms and Conditions used in the automobile trade, which are typically printed on the backs of the contracts, have been drawn up jointly by the three auto industry associations VDA, VDIK and ZDK, and then recommended to their respective memberships for use on a non-binding basis. They include the Terms and Conditions for New Vehicle Sales (NWVB), the Terms and Conditions for Used Vehicle Sales (GWVB), and the Terms and Conditions for Motor Vehicle Repairs (RepB), all of them version 12/2016. While the Terms and Conditions for New Vehicle Sales are a non-binding recommendation by all three associations VDA, VDIK and ZDK, the Terms and Conditions for Used Vehicle Sales, the Terms and Conditions for Motor Vehicle Repairs, the Terms and Conditions for Parts Sales, Conditions for Parts Purchase and the Used Vehicle Warranty Terms come recommended by the ZDK.

The three associations' legal experts, along with legal experts from various companies, observe and analyze relevant court decisions and legal literature on an ongoing basis in order to deliberate and decide on potential or necessary changes to these Terms and Conditions. However, said recommendations do not constitute any guarantee whatsoever for the accuracy or suitableness of the Terms and Conditions, or for the legal admissibility of the proposed contractual clauses.
